The Privacy Policy (“Privacy Policy”) is updated periodically and updates are published on our website.

2. Applicability

This Privacy Policy explains how we collect, use and otherwise process your personal data in the course of our business, when you collaborate with us regardless of your role, when you participate in our campaigns/projects and/or of our partners or you are their beneficiaries.

This Privacy Policy covers and addresses the following categories of persons:

a) DONORS, VOLUNTEERS AND OTHER PARTNERS OF THE FUNDATIA BOSCH ROMANIA

This category refers to the partners OF THE FUNDATIA BOSCH ROMANIA who:

support in their own names as donors, volunteers or jurors the work of the Foundation by getting involved in the campaigns it runs.

are the representatives of the contractual partners with whom the FUNDATIA BOSCH ROMANIA has had or continues to have a contractual relationship for the implementation of its activity and the campaigns it carries out – e.g. representatives and contact persons from the associates and foundations that collaborate with the FUNDATIA BOSCH ROMANIA, representatives and contact persons from suppliers that provide various services or from whom the FUNDATIA BOSCH ROMANIA has purchased various goods or services.

b) BENEFICIARIES OF THE CAMPAIGNS CARRIED OUT BY THE FUNDATIA BOSCH ROMANIA:

This category refers to individuals (adults and minors) who benefit from the services and products resulting from the campaigns that the FUNDATIA BOSCH ROMANIA carries out as part of its activity – e.g. beneficiaries of projects funded by the FUNDATIA BOSCH ROMANIA, beneficiaries of individual donation campaigns.

c) CANDIDATES AND EMPLOYEES OF THE FUNDATIA BOSCH ROMANIA:

This category refers to individuals who apply for employment within the FUNDATIA BOSCH ROMANIA as well as to individuals with whom the FUNDATIA BOSCH ROMANIA has or has had an individual employment relationship.

The categories of personal data we process differ depending on your relationship with us as well as how you interact or have interacted with the FUNDATIA BOSCH ROMANIA.  Below is a general list of these categories, with the mention that the applicable lists for each category of persons interacting with the FUNDATIA BOSCH ROMANIA are detailed in the following sections:

Health data – namely data from medical certificates that attest to the type and degree of your disabilities necessary to get involved and to be the beneficiary of the campaigns conducted BY FUNDATIA BOSCH ROMANIA  or the data necessary for your employment within the Foundation. 

6.2. Where do we get your data?

We will collect your personal data:

Directly from you, i.e. when you communicate the information directly to us (e.g. by filling out a form) or through your interaction with our representatives.

For example, we will obtain your personal information when: (i) you sign up to judge a campaign conducted by the FUNDATIA BOSCH ROMANIA, (ii) you apply to benefit from our programs, (iii) you apply for a position within the FUNDATIA BOSCH ROMANIA or (iv) you contact us through various channels, or request information about the campaigns and events carried out by the FUNDATIA BOSCH ROMANIA  

When we receive the data directly from you we will consider that it is real, accurate, complete and that it belongs to you or, as the case may be, you have the right to use it.  We will make every effort to ensure that the data is real, accurate and yours, and if there are suspicions that you are sending us incorrect, incomplete data or that you are using another person’s data without authorization, we will take care to remedy or terminate this situation.  For example, the measures may consist of: Updating, filling in or deleting data, limiting access to illegally used data – including deleting accounts associated with data that does not belong to you

We will also consider that the data collected directly from you is up to date as long as you have not requested their modification through the communication channels referred to in point 4 of the Privacy Policy or have not personally updated the data.

Sources other than you, or data obtained from external sources.

External sources from which we may obtain your data include:

Public sources, for example, websites or social media pages, public databases (including the Trade Register database, the Ministry of Finance database, the Official Gazette, court portals, etc.);

7. If you are a donor, volunteer or other partner of the FUNDATIA BOSCH ROMANIA

We will process the following personal data:

Identification data: Name, surname, and depending on the activity you will carry out, we will also be able to process information regarding the address, copy of the identity document and your signature, as the case may be;

Contact data – your telephone and/or mobile number, and your email address, as applicable;

Data collected by cookies and similar technologies related to web platforms managed by the FUNDATIA BOSCH ROMANIA that you visit.

Authentication data – passwords, suggestions and similar security information used for authentication and access to the platforms applicable to the campaigns run by the FUNDATIA BOSCH ROMANIA that you will use;

Your image/voice – photos, videos as appropriate;

Data on your professional experience – i.e. data from your CV or other qualifications, only to the extent that you will carry out an activity supported by the FUNDATIA BOSCH ROMANIA or for this purpose (e.g. you will be part of the Board of Directors). 

We will use your personal data for the following purposes:

7.1. Eligibility checks

Before your involvement in the project developed by the FUNDATIA BOSCH ROMANIA and depending on the specific activity to be carried out, we may carry out certain checks to determine whether you are eligible for your involvement in that activity, as follows:

In the case of volunteers or partners who will be involved in the projects carried out by the FUNDATIA BOSCH ROMANIA, it may be necessary to check your CV in order to check if you have the necessary skills for that project;

In the case of persons to be appointed as members of the Board of Directors of the Foundation, it may be necessary to verify your CV as well as how the other necessary conditions are met for this position.

the legitimate interest of the FUNDATIA BOSCH ROMANIA to verify the fulfillment of the necessary criteria for your involvement in the development of the FUNDATIA BOSCH ROMANIA projects.

7.2. Implementation of the activities carried out by the FUNDATIA BOSCH ROMANIA – projects, campaigns

Depending on your involvement in the FUNDATIA BOSCH ROMANIA projects, we will process your personal data as follows:

in the case of volunteers or partners who will be involved in the projects carried out by the FUNDATIA BOSCH ROMANIA, your personal data will be processed to allow access to the online platforms on which the project is carried out, but also for the development and implementation of the project.  Personal data processed for this purpose are contact data, data on cookies and technologies, authentication data;

in the case of donors involved in the projects carried out by the FUNDATIA BOSCH ROMANIA, your personal data will be processed either to allow access to the platforms where you will be able to make the donations or, as the case may be, to finalize the donations and to communicate with you in relation to them.  Thus, the personal data processed for this purpose are contact data, contact data, data on cookies and technologies, authentication data;

if you are a contact person or legal representative of a legal entity partner TO THE FUNDATIA BOSCH ROMANIA, we will process your identification data (e.g., name, surname, position, signature) if we need to sign a contract with you and you act as a signatory party.  We will also process your contact details (for example, your telephone number and email) if you have been appointed to act as our partner’s contact person, in relation to us and we may use that data to contact you in connection with any issues relating to our business relationship with you. (e.g., payment processing, contract performance, etc.)

Based on this information, the FUNDATIA BOSCH ROMANIA MAY generate aggregated and statistical management reports that do not identify you individually.  Also, the FUNDATIA BOSCH ROMANIA can retrieve this personal data and anonymize it in order to carry out a more in-depth analysis of the activities carried out.

Communications on the events organized by the FUNDATIA BOSCH ROMANIA

We want to use your Contact data to keep you up to date on the events and projects carried out by the FUNDATIA BOSCH ROMANIA team.  In this context, we may send you newsletters regarding our activity, the events organized by us, as well as the projects we are about to implement.

7.4. Relationship with authorities/dispute resolution and litigation

We process personal data where this is reasonable to protect us against fraud, defend our rights or property, or to protect the interests of our partners in the context of potential or existing disputes or disputes in which the FUNDATIA BOSCH ROMANIA may be involved, including any proceedings before any administrative, criminal, arbitral or civil courts or institutions.

Before your involvement in the project developed by the FUNDATIA BOSCH ROMANIA , we may carry out certain checks to verify that you are eligible to be a beneficiary of our campaigns, as follows:

In the case of individual projects, we will be able to check the supporting documents that you will provide to us, including documents attesting your health status, based on which you request the support OF the FUNDATIA BOSCH ROMANIA;

In the case of the other projects carried out by the FUNDATIA BOSCH ROMANIA, we will be able to process according to their specifics other personal data necessary for your involvement in the respective project – e.g., data on your address, your income, etc.

8.2. Implementation of the activities carried out by the FUNDATIA BOSCH ROMANIA – projects, campaigns

Depending on your role in the FUNDATIA BOSCH ROMANIA projects, we will process your personal data as follows:

In the case of individual projects carried out by the FUNDATIA BOSCH ROMANIA, we will use your contact details as well as financial data in order to run the fundraising campaign;

In case of certain campaigns / projects carried out by the FUNDATIA BOSCH ROMANIA, we will be able to publish a number of limited personal data about you on the online platforms, necessary for the running – e.g., within the Volunteer Platform we will be able, subject to your consent. / of your guardian, publish the image, name of the campaign

Depending on the specifics of the campaign / project carried out by the FUNDATIA BOSCH ROMANIA, we will be able to provide your limited personal data necessary for the implementation of the project – e.g. identification data, contact data.

We process your personal data in order to carry out internal and/or external communications, respectively in the offline environment (various presentations, promotional events or internal communications), as well as on various online media, on the FUNDATIA BOSCH ROMANIA website, on the social media pages managed by the FUNDATIA BOSCH ROMANIA or through other means of public awareness in order to promote the activity carried out by the FUNDATIA BOSCH ROMANIA, including the projects/campaigns carried out by our partners and financed by us.

FUNDATIA BOSCH ROMANIA obtains your consent through the partners of the FUNDATIA BOSCH ROMANIA when, as a direct beneficiary of the campaigns/projects carried out by our partners, you choose to express your consent for the transmission and use by the FUNDATIA BOSCH ROMANIA of your personal data personally for the purpose mentioned above.

10. If you are a candidate / employee of the FUNDATIA BOSCH ROMANIA  

We will use your personal data for the following purposes:

10.1. Recruitment activity

If you apply for a position within the FUNDATIA BOSCH ROMANIA, we will process your personal data for the purposes of your recruitment and placement at work, including for the purpose of notifying future employment opportunities, and in the case of admitted candidates, for the purposes of employment.

collecting data on the quality and quantity of performance in order to carry out our work and at the same time manage your performance;

fulfilling our legal obligations, such as paying taxes and contributions, maintaining contact with the competent authorities, submitting statements;

Thus, in order to implement the operations described above, we will be able to process the following categories of personal data: contact details, identification data, payment information, holiday details, limited information on your health status, qualifications, professional history, training details, safety information, information on your presence at work

We disclose your personal data to persons authorized by the FUNDATIA BOSCH ROMANIA to process personal data, respectively entities we employ to provide services on our behalf.  We have written contracts in progress with the persons authorized by it to process personal data by which they undertake not to take action in relation to your personal data except on the basis of instructions from us.  The authorized persons will undertake to keep your personal data secure for the entire period indicated by us.

Also, when we are obliged or entitled, we may disclose your personal data to third parties acting as independent controllers (entities processing the data for their own purposes) or, where applicable, entities acting as controllers associated with us (in which case we determine together with them the purposes and/or means of data processing).

12. Retention and storage of your personal data

The FUNDATIA BOSCH ROMANIA has implemented policies and rules on the retention of personal data, which comply with the data retention principles provided by the legislation on the protection of personal data.  Retention periods shall be reviewed periodically.

In general, we will retain your personal data (1) for the duration of the contract with us or the duration of the project in which you are involved, plus a reasonable period (depending on the circumstances); (2) for the duration provided by law or established by a public authority, under the law; (3) in case of disputes or disputes, until their closure, plus a reasonable period (depending on the circumstances); (4) until the withdrawal of consent when the processing has as a legal basis your consent. 13. International data transfers
